Workplace Injuries and Construction Accidents

In 2007, there were 362 workplace deaths in the state of Florida. Nationwide, there are well over 5000 per year out of 3 million industrial accidents. That means that workplace accidental deaths in Florida are responsible for almost ten percent of the nationwide total of workplace fatalities. This isn’t surprising, because 25% of those fatal accidents occur on construction sites, and there is a lot of construction in Florida.

Worker’s Compensation

Many, but not all, of workplace accidents in Florida are covered by Florida’s Worker’s Compensation system. Only a lawyer familiar with all the ins and outs of this system, like Rafael Gonzalez is, can make the system work for you the way that it is supposed to work.

Worker’s Comp will cover you if you are injured on the job and the only negligent party is the employer or yourself. If there are intervening third parties, like often happens on a construction site, you will not necessarily be limited to your Worker’s Comp claim.

For the most part, Florida pays out Worker’s Comp claims for injuries to the neck, knees, and back; for carpal tunnel and similar injuries; for work- induced heart attacks, strokes, and emotional problems; for work- related hearing loss; for work- related pulmonary problems; for injuries from toxic substances at work, and for loss of the use of you limbs, eyes, etc.

Going Outside of Worker’s Comp

The compensation is generally less than one would receive if the injury was litigated, because it is parceled out as a percentage of your income. Because of this, it is always in our clients’ best interests to see if there may be a third party at fault in the injury.

This may especially be true in construction site accidents, where many subcontractor work in the same area, and where your injury may not have come from the actions of your actual employer.
