Personal Injury
Florida personal injury law is very complex. If you have been injured in an accident, you need a veteran injury lawyer to help guide you through the process, to make sure that your rights are completely protected, and to make sure that you receive the maximum amount of compensation allowed under the law.
The term “personal injury” covers a wide variety of events. Usually, it refers to one person being injured by the negligent acts of another person. A personal injury can include:
- automobile accidents
- slip and fall injuries
- boating accidents
- workplace accidents
- medical malpractice
- injuries on public property
- injuries by a product you purchased
- and many more kinds of injuries
If you have been injured by the negligence of another person or by the negligence of a company, you may be entitled to compensation in the form of money, or other damages.
You can receive compensation for medical expenses, pain and suffering, loss of wages, and loss of services.
These damages are available to you in full if the accident was not your fault in any way. If there is a question as to whose fault the injury was, you will then be under Florida’s comparative negligence statutes.
If the other side can prove that your actions contributed to your injury, the jury can deduct a percentage from the damages award.
Florida also follows a rule called the “Fabre Doctrine” Under this rule, a jury can assign a percentage of blame to a third party, even of not an actual party to the lawsuit, if the jury finds that that third party shared the fault for the injury. The third party is often not collectable, and so the damages become reduced, to the detriment of the injured party.
Combating both of those rules requires the services of a lawyer who knows the ins and outs of Florida personal injury law.
